Terms of Use

Before you start

FitClock asks you to exercise, which carries risk of injury. It is not a medical device. Set targets you can manage, and always keep a backup alarm for anything you genuinely cannot miss.

These terms are an agreement between you and Cyber Phoenix LTD, a company registered in England and Wales, covering your use of the FitClock iPhone app and the fitclockapp.com website. By downloading or using FitClock you accept these terms. If you do not accept them, do not use the app.

1. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use FitClock on Apple devices you own or control, in line with Apple's App Store Terms of Service. You may not copy, redistribute, resell, reverse engineer or attempt to extract the source code of the app, except where that restriction is prohibited by law.

2. Health and safety

FitClock asks you to exercise. Exercise carries risk of injury. FitClock is a fitness and wake-up tool, not a medical device, and nothing in the app is medical advice.

  • Consult a doctor before starting any new exercise routine, particularly if you are pregnant, recovering from injury or illness, or have a heart, joint, back or blood pressure condition.
  • Set rep targets you can actually manage. You choose your own starting numbers and you can change them at any time.
  • Clear enough space around you before starting a mission and make sure the floor is not slippery.
  • Stop immediately if you feel pain, dizziness, chest discomfort or shortness of breath.

The form score is an estimate produced by a computer vision model. It is a rough guide, not coaching from a qualified professional, and it can be wrong. Do not rely on it as your only judge of whether a movement is safe for your body. You exercise at your own risk.

3. Alarm reliability

FitClock schedules alarms using Apple's system alarm framework, which is designed to ring through Silent mode and Focus. However, no alarm app can guarantee delivery in every circumstance. A flat battery, a powered-off device, a hardware fault, a change to your operating system settings, or an operating system update can all stop an alarm sounding.

Do not rely on FitClock alone for anything where missing the time would cause you serious loss, such as a flight, an exam or a medical appointment. Set a backup. We are not liable for anything you miss.

4. Subscriptions

FitClock is free to download. FitClock Pro is an auto-renewing subscription purchased through your Apple Account.

  • Where a free trial is offered, your subscription begins automatically at the end of the trial unless you cancel at least 24 hours before it ends.
  • Subscriptions renew automatically at the end of each period unless auto-renew is switched off at least 24 hours before the renewal date.
  • Payment is charged to your Apple Account at confirmation of purchase and on each renewal.
  • You can manage or cancel your subscription in the Settings app on your iPhone, under your name, then Subscriptions. Deleting the app does not cancel a subscription.
  • Prices are shown in your local currency before purchase and may change. Any change to the price of an existing subscription will be notified to you by Apple in advance, and requires your consent to continue.

5. Refunds

All purchases are processed by Apple, so refunds are handled by Apple and are subject to Apple's policy. Request one at reportaproblem.apple.com. We cannot issue refunds directly because we never receive your payment. If you think something has gone wrong, contact us anyway and we will help where we can.

6. Acceptable use

Do not use FitClock unlawfully, do not attempt to interfere with or circumvent its security, and do not attempt to gain access to paid features without paying for them.

7. Intellectual property

FitClock, the FitClock name, the app's design, artwork, audio and code are owned by Cyber Phoenix LTD and protected by copyright and other intellectual property law. Nothing in these terms transfers ownership to you.

8. Changes to the app

We may add, change or remove features, and we may stop supporting older operating system versions. We may also discontinue FitClock entirely, in which case we will give reasonable notice through the app or this website where we are able to.

9. Liability

FitClock is provided on an as-is basis. To the fullest extent permitted by law, we exclude implied warranties and we are not liable for indirect or consequential loss, loss of profit, loss of opportunity, or anything you missed as a result of an alarm not sounding. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited. If you are a consumer, your statutory rights are unaffected.

10. Apple

This agreement is between you and Cyber Phoenix LTD, not Apple. Apple is not responsible for FitClock or its content, and has no obligation to provide support for it. Apple and its subsidiaries are third party beneficiaries of these terms and may enforce them against you.

11. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except that if you are a consumer resident elsewhere in the UK you may also bring proceedings in your local courts.
